The Inadmissibility Rules

This guide from Right to Remain (last updated July 2024) explains the inadmissibility rules introduced in January 2021 following Brexit, which replaced the Dublin III Regulation and allow the Home Office to decline to consider an asylum claim in the UK if the claimant had a connection to a safe third country. It covers who is affected and who is excluded (including unaccompanied children and families with under-18s), at what stage of the asylum process the rules can apply, and what happens when a Notice of Intent is issued — including how to dispute it and the option of judicial review. The guide also traces the rise and fall of the Rwanda plan, including the November 2023 Supreme Court ruling and the subsequent scrapping of the Safety of Rwanda Act by the Labour government in July 2024, as well as a July 2024 legal settlement requiring the Home Office to treat Rwanda inadmissibility cohort cases as priority claims.
