Applying to Stay in the UK Because You Have Children

This guide from Right to Remain explains how a parent may apply for leave to remain in the UK when their child holds British citizenship, has lived in the UK for seven years, or has Article 8 family/private life rights — covering the key eligibility criteria for each route. It sets out what applicants must demonstrate, including sole parental responsibility or direct access, an active role in the child's upbringing, financial independence, and English language ability, and gives practical guidance on the evidence required. The guide also explains the "best interests of the child" (Section 55) duty, suitability requirements, application fees, fee waivers, and what happens if an application is refused.
