Understanding the Different Asylum and Immigration Courts

This guide from Right to Remain introduces the hierarchy of courts that may hear asylum and immigration cases beyond the First-tier Tribunal and Upper Tribunal, including the Court of Appeal (England & Wales), Court of Appeal (Northern Ireland), Court of Session (Scotland), the High Court, the UK Supreme Court, the European Court of Human Rights, and the European Court of Justice. For each court it explains the conditions under which permission to appeal may be sought, how to apply for that permission, and the geographic jurisdiction involved. It also clarifies the continued relevance of the European Convention on Human Rights to the UK post-Brexit, and the limited, post-Brexit role of the CJEU. A key caveat throughout is that succeeding at any of these levels is very difficult without qualified legal representation.
