Making a Fresh Claim (new evidence after the appeals stage)
This guide from Right to Remain explains the process of submitting further submissions and making a fresh asylum or human rights claim to the Home Office once an appeal has been dismissed and an applicant becomes "appeal rights exhausted." It covers the legal fresh claims test set out in Immigration Rule 353 — including what "significantly different," "taken together with previously considered material," and "realistic prospect of success" mean in practice — and sets out the range of grounds on which a fresh claim might be based, such as new documentary evidence, changed country conditions, or new case law. The guide also addresses how to prepare and submit a fresh claim, credibility considerations, the impact of the inadmissibility rules, what happens after a Home Office decision, and notes the change in permission-to-stay periods for claims made on or after 2 March 2026. It is aimed at asylum seekers and their supporters, and cautions that poor-quality submissions can worsen an applicant's position.
